Michael Fong v. Sun Pharmaceuticals Corp. and Platex Products, Inc., Case No. BC328875 in the Superior Court of the State of California for the County of Los Angeles.

Plaintiffs allege that Energizer, which manufactures Banana Boat and Hawaiian Tropic sunscreen products, violated California state laws regarding the labeling and advertising of certain sunscreen products.
Energizer denies all wrongdoing. The Court did not decide which side was right and instead, the parties decided to settle. They believe the proposed settlement is fair, reasonable, and adequate.

about the case and the Settlement.
Class Member Definition
The Settlement Class consists of all natural persons and entities residing in the State of California who purchased Eligible Banana Boat from February 16, 2001 through December 18, 2013 and Hawaiian Tropic
Sunscreen Products from February 14, 2001 through December 18, 2013.
Class Member Options
If you do nothing, you will be bound by the terms specified in the Settlement Agreement, which may be found on the Key Dates/Docs page of this website.
EXCLUDE YOURSELF ON OR BEFORE MARCH 27, 2014
If you wish to exclude yourself from the Settlement, mail a written request for exclusion to the Settlement Administrator at the address on the Contact Us page.
The request for exclusion must be postmarked by March 27, 2014.
OBJECT ON OR BEFORE MARCH 27, 2014
If you wish to object to the Settlement, you must file your objection with the Court so that it is received no later than March 27, 2014. Please visit the Common Questions page for further directions.
